Right of Withdrawal

RIGHT OF WITHDRAWAL
(1) If you are a consumer (i.e., a natural person who places an order for purposes that cannot be predominantly attributed to your commercial or self-employed professional activity), you have the right of withdrawal in accordance with the statutory provisions.

(2) However, there is no right of withdrawal for distance contracts for the provision of services related to leisure activities if the contract specifies a specific date or period for performance (§ 312g Abs. 2 Sentence 1 No. 9 of the German Civil Code - BGB). Therefore, tickets purchased online for a specific date or period are not subject to the right of withdrawal.

Right of Withdrawal When Purchasing Vouchers

The following right of withdrawal applies only if the buyer is a CONSUMER as defined in § 13 BGB, i.e., if they place the order for purposes that are predominantly not attributable to their commercial or self-employed professional activity. The right of withdrawal applies exclusively to ONLINE ORDERS OF VOUCHERS, meaning it does not apply if the voucher was purchased on-site at the Triberg VR Arena or when purchasing individual tickets for a fixed date.

a. Right of Withdrawal
The buyer has the right to withdraw from the contract within 14 days without providing any reasons. The withdrawal period begins on the day the buyer or a third party designated by them, who is not the carrier, takes possession of the goods, or in the case of a service contract, upon conclusion of the contract.
To exercise their right of withdrawal, the buyer must inform the Stadt Triberg (Hauptstraße 57, D-78098 Triberg, Fax: +49 (0)7722 953-223, Email: Stadtverwaltung@triberg.de) of their decision to withdraw from the contract through a clear statement (e.g., a letter sent by post, fax, or email).
To comply with the withdrawal period, it is sufficient for the buyer to send the notification of exercising the right of withdrawal before the withdrawal period expires.

 

 b. Consequences of Withdrawal

If the buyer withdraws from the contract, the Stadt Triberg shall refund the payments received from the buyer, including delivery costs (except for additional costs resulting from the buyer choosing a type of delivery other than the least expensive standard delivery offered by the Stadt Triberg), without delay and no later than 14 days from the day the notification of the buyer's withdrawal is received by the Stadt Triberg. For this refund, the Stadt Triberg will use the same payment method that the buyer used for the original transaction, unless expressly agreed otherwise with the buyer; in no case will the buyer be charged any fees for this refund.
Returning an online purchased voucher to the Stadt Triberg after withdrawal is not required. The Stadt Triberg will block the voucher upon receipt of the withdrawal. If the buyer has expressly requested that the Stadt Triberg begins redeeming the voucher before the withdrawal period expires, they owe the Stadt Triberg compensation for the value of the services provided up to the withdrawal, which corresponds to the proportion of the service rendered up to that point compared to the total scope of the services provided for in the contract.

c. Expiration of the Right of Withdrawal
The right of withdrawal expires before the end of the period mentioned in Section 13 a. if the voucher is fully redeemed at the express request of the buyer and the Stadt Triberg has only begun redeeming the voucher after the buyer has confirmed their understanding that they lose their right of withdrawal upon full performance of the contract by the Stadt Triberg.
